Thanks for using our products and services.

Please carefully review the following rules that govern your use of our Site and also read our Privacy Notice regarding the information that you provide to us. These Terms and Conditions of Use (“Terms of Use”) apply to the World Wide Web site owned, operated, licensed, and controlled by The PC Debit Card LLC including its related, affiliated, or subsidiary companies (collectively, the “Site”). This Site is the property of PC Debit Card LLC . By using this Site, you agree to these Terms of Use; if you do not agree, do not use this Site.

These Terms of Use hereby incorporate by reference specific terms, descriptions, conditions, limitations and exclusions relating to PC Debit Card LLC services that may be provided under each of its membership programs. These specific terms are set out under Support and the Frequently Asked Questions (“FAQ”) underlying each program. PC Debit Card LLC reserves the right at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

As long as you comply with these Terms of Use, PC Debit Card LLC grants you a personal, non-exclusive, non-transferable, limited license to enter and use the Site or the PC Debit Card LLC App and access its services including the opportunity to apply for funding, access free credit scores, access free personal financial management tools, participate in the PC Debit Card LLC financial network, and redeem points for gift cards (the “Services”). This license to access the Site is for your own personal use and not for any commercial or business purpose (“Your Membership”).

Subject to applicable law, we reserve the right, in our reasonable discretion, to terminate Your Membership, your use of the Site, your user account or any Product provided to you (subject to the terms of product agreement) and to assert our legal rights with respect to content or use of the Site that we reasonably believe is, or might be, in violation of these Terms or the Terms of any PC Debit Card LLC Product.

PC Debit Card LLC provides an application for business and financial services. Please note that PC Debit Card LLC is not a credit repair company or credit services organization. We do not provide credit repair services to repair your credit profile or score. Our Services are meant only as an aid to assist you in organizing and managing your finances and Business Practices. All information is provided for educational use only. The Service is not intended to provide any legal, tax or financial advice. The PC Debit LLC hires and contracts licensed professionals for all business and marketing services. You acknowledge that your personal financial circumstances are unique, and that before any information you obtain through the Service is acted upon, you should obtain the advice of a financial advisor or other financial planning professional who is aware of your personal financial circumstances.

Privacy

Please review our Privacy Notice (which also governs your visit to our Site) to understand our practices. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure and that any message or information you send to the Site may be read or intercepted by others, notwithstanding our efforts to protect such transmissions.

Intellectual Property

This Site, the content, any materials downloaded, and all intellectual property pertaining to or contained on the Site (including but not limited to copyrights, patents, database rights, graphics, designs, text, logos, trade dress, trademarks and service marks) are owned by PC Debit Card LLC or third parties and all right, title and interest therein shall remain the property of PC Debit Card LLC and/or such third parties (collectively, the “Content”).

Electronic Communications

When you visit PC Debit Card LLC (www.MyPCcard.com) or you send emails to us, you are communicating with us electronically and you consent to receive communications from us electronically to the extent permissible by law. We will communicate with you by email or by posting notices on this Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, to the extent permissible by law.

You agree that we may send emails to you, for the purpose of advising you of any changes or additions to this Site, changes to any of our products or services, or for such other purposes as we deem appropriate and as permissible by law. By utilizing our loans and services, you agree to our ESIGN consent and agree to receive disclosures and other information in electronic form. Please make sure to review the Consent to ESIGN and Electronic Communications below for further information about e-sign consent related to loan documents and other agreements.

Consent to ESIGN and Electronic Communications

This Consent to ESIGN and Electronic Communications (“E-Sign Consent”) constitutes your consent to receive disclosures, communications and other information in electronic form from PC Debit Card LLC (“PC Debit Card LLC ”) and its affiliates and third-party providers, including Pathward, N.A. (“Meta”). This E-Sign Consent applies to all current and future communications related to your PC Debit Card LLC account and membership, loans you may take from affiliates of PC Debit Card LLC.

“We”, “us” and “our” refers to PC Debit Card LLC , Meta and their affiliates. “You” or “your” refers to the person providing this consent. “Communications” means any membership agreements and other customer agreements, disclosures, privacy policies, bank account statements, transaction histories, loan applications, loan agreements, notices, responses to claims, fee schedules, and all other information in connection with your PC Debit Card LLC account and related products or services, including but not limited to information that we are required by law to provide to you in writing, such as Truth in Lending Act disclosures and tax forms.

 

Consumer Consent:

Before completing any transaction with us, you will be asked to agree to this E-Sign Consent, which constitutes your agreement to the following:

  • We may provide disclosures required by law and any other information concerning your legal rights and duties and your account and related products and services to you electronically.

  • Your electronic signature on agreements and documents has the same effect as if you physically signed the document with a pen.

  • You will not contest the legal effectiveness, validity, enforceability or use of the electronically stored copies of any agreements electronically signed by you based on the fact that the terms were accepted electronically.

  • You have the hardware and software and other technology described in the “Minimum Requirements” section below necessary to receive, review, download and save any Communications sent electronically. 

  • You have an active email account and have provide us with correct and up-to-date information relating to that account.

This consent applies to any transaction undertaken through MoneyLion in the past, to all future disclosures and communications on your account, to all future transactions with us, and to other Communications that we provide to you electronically.

Your consent is effective immediately and will remain in effect until you tell us that you no longer agree to receive Communications electronically by sending us notice in the manner described in the “Withdrawing Consent; Paper Communications” section below.

Method of Delivery

We will provide Communications to you by posting them on the Site, by posting them in the App and/or by emailing you at your registered email address. You agree that you will be deemed to have received certain Communications when they are posted to a publicly available website. We may post documents and other Communications to the Site or App without providing notice to you. You agree to check the Site and App regularly, as you may have no other way to know the Communications have been delivered to you. It is your responsibility to keep your registered email address up to date so that we can communicate with you electronically. You can change your registered email address by calling PC Debit Card LLC customer service at 800-948-5980. You agree that any email address you provide may be used to provide you with Communications, and you agree to notify the PC Debit Card of any changes in your email address by notifying PC Debit Card LLC either in writing or via email at least five (5) days before the change. 

You agree that electronic delivery of Communications in any of the ways described in this E-Sign Consent will constitute good and effective delivery to you when posted or sent, regardless of whether you actually or timely receive or access the Communications. You also agree that we are not responsible for any delay or failure in your receipt of any email notice that is not caused by our failure to send such a notice to the email address you have provided for that purpose.

Minimum Requirements

To electronically receive, view and save or print the Communications, you must have a personal computer or mobile device with a connection to the internet that is equipped with the following, and an operating system that supports these requirements:

  • A current version of Google Chrome, Mozilla Firefox, Microsoft Internet Explorer, Safari or other internet browser that we support 

  • Adobe Acrobat Reader installed on your device or the ability to view Hyper Text Markup Language (HTML)

  • Either a printer, a hard drive or other storage device

We will provide you with notice of any significant change in the hardware or software requirements needed to access or retain Communications electronically.  Your continued use of our electronic services after receiving notice of updates to these requirements constitutes your acceptance of the changes and your reaffirmation of this E-Sign Consent.

Withdrawing Consent; Paper Communications 

Prior to creating a PC Debit Card LLC account, you may withdraw your consent to electronic disclosures by exiting the Site or the App. Additionally, you are free to withdraw your consent to receive electronic Communications at any time if you choose to. You may also request that we send you paper copies of Communications that the law requires us to provide to you. If at any time you wish to withdraw your consent or request paper copies of Communications, you can do so by submitting a request through the PC Debit Card LLC helpdesk.

 

You agree that if you withdraw your consent or request paper copies of Communications, we may close your PC Debit Card LLC account or otherwise restrict, revoke or terminate your account and your access to other products and services we provide, subject to the terms of any additional agreement we have with you. Such termination does not exterminate any obligations you may have to PC Debit Card LLC or their affiliates. To the extent permitted by law, we may also charge you a reasonable service charge for the delivery of paper copies of any Communication.

If you decide to withdraw your consent, the legal effectiveness, validity and/or enforceability of prior electronic Communications will not be affected.

Legal Effect

Your consent to this E-Sign Consent means that Communications we provide to you electronically shall have the same effect as if provided in paper form. A message alerting you that Communications are available electronically, provided that the Communications are made available electronically, shall have the same meaning as if we had provided them to you in paper form, regardless of whether you actually view them, unless you have withdrawn your consent pursuant this E-Sign Consent, prior to receiving such Communications.

Termination; Changes

You agree that we may modify or change the methods of disclosure described herein, and that we may send you Communications in paper form at our option, though we assume no obligation to do so. We will provide you with notice of any such modification as required by law.

Accounts

In order to access or use many of the features offered by PC Debit Card LLC or its affiliates in connection with the Services, you will be required to log-in to PC Debit Card LLC and create an account (your “Account”). The Services’ practices governing any resulting collection and use of your personal information are disclosed in PC Debit Card LLC privacy notice, located at PC Debit Card LLC  (the “Privacy Notice”). If you register for any Service that requires a password and/or username, then you will select your own password at the time of registration (or we may send you an e-mail notification with a randomly generated initial password) and you agree that:

  • You are eighteen years of age and hold a valid U.S. Social Security Number;

  • You will not use a username (or e-mail address) that is already being used by someone else, that infringes the intellectual property or other right of any person or entity, or is offensive;

  • You will provide true, accurate, current, and complete information about yourself in connection with the registration process;

  • You are solely responsible for all activities that occur in connection with your Account, password, and username;

  • You are solely responsible for maintaining the confidentiality of your password and for restricting access to your Device so that others may not access any password-protected portion of the Services using your name, username, or password;

  • You will immediately notify The PC Debit Card LLC of any unauthorized use of your Account, password, or username, or any other breach of security; and

  • You will not sell, transfer, or assign your Account or any rights associated therewith.

If any information that you provide, or if we have reasonable grounds to suspect that any information that you provide, is false, inaccurate, outdated, incomplete, or violative of these Terms of Use, any additional terms applicable to the Services, or any applicable law, then PC Debit Card LLC may suspend or terminate your Account with or without providing advance notice. You acknowledge and agree that The PC Debit Card LLC also reserves the broad, general right to terminate or suspend your Account or to otherwise deny you access to it or its benefits in PC Debit Card LLC ’s sole discretion, for any reason or no reason, with or without advance notice. These Terms of Use will continue to apply until your formal relationship with PC Debit Card LLC is terminated, either by you or by PC Debit Card LLC . If you choose to terminate your use of the Services, you may do so by calling 800-948-5980. Once your use of the Services is terminated, your ability to log in may be deactivated. If you terminate your use of the Services, you will remain obligated to pay all outstanding fees and other amounts owed, if any, relating to your use of the Services. If you have any questions or trouble terminating the use of the Services, you can contact customer support for assistance. PC Debit Card LLC may continue to maintain information about you after your use of the Services is terminated only to the extent necessary to comply with applicable laws, and only to further legitimate business needs as outlined in PC Debit Card LLC ’s Privacy Policy.

All agreements and disclosures that you have entered into in connection with the Services govern your usage of both PC Debit Card LLC ’s App and website.

Use of the App

You agree to use the PC Debit Card LLC App in accordance with these Terms of Use and any applicable usage rules of any third-party mobile telephone, tablet or other device (each a “Mobile Device”) or service provider or the third-party from whom you are downloading the PC Debit Card LLC App (the “App Venues”). Supported App Venues include iTunes and Google Play; other App Venues are NOT supported. It is your responsibility to review the terms and conditions of any App Venue and to determine what usage rules of such App Venue apply to you depending on (i) your Mobile Device, (ii) the method by which you downloaded the PC Debit Card LLC App, and (iii) the App Venue from which you downloaded the PC Debit Card LLC App.

PC Debit Card LLC may offer Services to you through the PC Debit Card LLC App. You acknowledge and understand that certain Services available to you through the PC Debit Card LLC App require data access or wireless internet capability, including, but not limited to, your ability to conduct financial transactions, to alter your portfolio or to view your account balances. You agree that you are responsible for data access or wireless internet charges that may be imposed by your Mobile Device service provider. The PC Debit Card LLC App is designed to be accessible on multiple types of Mobile Devices and operating systems. PC Debit Card LLC does not, however, make any representation or warrant that the MoneyLion App will be compatible with your particular Mobile Device, any specific operating system version of your Mobile Device, or any other hardware, software, equipment or device installed on, or used in connection with, your Mobile Device. You agree that your functional use of the PC Debit Card LLC App may be affected by or dependent upon your wireless connection and speed of your wireless service provider.

The functionality of the PC Debit Card LLC App could become disabled due to poor connections or speeds caused by your location or your wireless or internet service provider while conducting financial transactions. You agree that it is your responsibility to verify the status of any attempted transaction by reviewing your Account or by contacting PC Debit Card LLC Customer Support at 800-948-5980. You acknowledge and agree that PC Debit Card LLC , and its affiliates, agents and licensors shall not be liable to you for any losses, financial or otherwise, suffered by or arising out of or resulting from compatibility or inoperability problems or the failure of, or your failure to confirm, any attempted transaction.

In addition to your obligations under these Terms of Use, you acknowledge, understand and agree that your use of the MoneyLion App and your access to your Account through the PC Debit Card LLC App is governed by your account agreements with MoneyLion Inc., its affiliates, partners, or third parties (“Account Agreements”). By using the PC Debit Card LLC App or website, you agree that PC Debit Card LLC may send communications to your Mobile Device and collect information from your devices, as described in PC Debit Card LLC ’s Privacy Notice. For instance, when accessing the MoneyLion App and our other Services through a Mobile Device, we may collect certain information about your Mobile Device and use of our Services, including your device identifiers (such as your Unique Device Identifier, Apple iOS IDFA or Android Advertising ID), the type of device you use and its operating system, information about other applications installed on your device (and, if you use an Android-based mobile device, how you use them – e.g., frequency and duration of use) and information about your use of our Services while using the Mobile Device. We may use such information, and share such information with relevant third-parties, to offer you promotions through various third-party providers of products or services, including for purposes of evaluating and providing you with the types of promotions that may be of interest to you or more relevant to you. Any unique device identifiers that we collect when you access or use our Services will be used only for advertising and analytics purposes.

Push Notifications (“Alerts”)

You agree to be contacted by PC Debit Card LLC , our agents, representatives, affiliates, about your account activity, balances, product offerings and other information, such as payment reminders or suspicious activity. When you consent to these Terms and Conditions, you are agreeing to receive Alerts through push notification(s). Receipt of Alerts may be delayed or prevented by factor(s) affecting your internet/phone provider or other relevant entities. PC Debit Card LLC is not liable for losses or damages arising from:

  • Non-delivery, delayed delivery, or the erroneous delivery of any Alert

  • Inaccurate Alert content.

  • Your use or reliance on the contents of any Alert for any purposes.

The information in any Alert may be subject to certain delays. Each Alert may not be encrypted and may include your name and information pertaining to your account(s). The PC Debit Card LLC may terminate your use of Alerts at any time without notice. You may choose to discontinue receiving Alerts by updating your PC Debit Card App notification preferences.

Links to Other Web Sites and Services

This Site contains links to outside services and resources (“Third-Party Content”), the availability and content of which PC Debit Card LLC does not control. Some Third-Party Content may be custom matched based on information provided by you to PC Debit Card LLC . We are not responsible for examining or evaluating, and we do not warrant the offering of these businesses or individuals or the content of their web sites. PC Debit Card LLC does not assume any responsibility or liability for the actions, products, and content of these and any other third-parties. PC Debit Card LLC does not guarantee that any service offered by Third-Party Content will be offered to you. PC Debit Card may receive compensation from third-parties for referring you to the third-party or to their website. Any services that you obtain through Third-Party Content will be subject to the terms and conditions and Privacy Notice of the Third-Party Content. Any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service or resource.

However the network will assist business owners to revamp or change their services or products to serve a broader base.

  • The Network Reserves the right to refuse service to any business or organization that our Network deems destructive to the individual person, environment or community.

  • The Network’s standards and value-system is taken from the Holy Bible. The B2B Network does not operate by religious or society’s standards, beliefs and practices.

  • The B2B Network will also abide-by and use the guides and standards of the  local City, State, Chambers of Commerce, SBA and Better Business Bureaus etc.

THE PC DEBIT CARD WILL NOT FUND OR SERVICE THE FOLLOWING:

  1. Alcohol and Liquor (only stores)

  2. Night Clubs & Bars

  3. Tobacco, Cigar, Marijuana or any drug-related products (only stores)

  4. Pornography or sex related entertainment, products or services.

  5. Counseling Services that counsels against the Holy Bible.

  6. Any organizations or materials that teach or market specifically against the Gospel and Teachings of the Holy Bible.

  7. Predatory lending and financial institutions.

  8. Weapons, guns, knives etc. (only stores or services)

  9. Gambling, Lotteries or Casinos

  10. Clothing and images that are deemed inappropriate and offensive.

  11. Entertainment, Productions, Shows, Concerts, Music etc. that includes, promotes, glorifies or encourage self and community destruction and or destructive behaviors or hate or violence against another group or person.

  12. Organizations and agencies that promotes racism, hate and or violence against or towards another group.

  13. Lobbyists, local, city, state or Government officials and or elections.

The PC Debit Card reserves the right to refuse service or funding to any person or group that provides services or products that are not in-line with our stated values, mission and principles.

All funding for all projects are 100% private funds generated from services provided to corporate and individual organizations and companies. The PC Debit Card and all Associated Platforms has not and will not receive any charitable funding from corporations, individuals, the government or local agencies in the form of public contributions, donations or grants.

Customer Data Usage

PC Debit Card LLC may use Customer data for (i) improvement of services; (ii) to the extent permitted by law to use, distribute, and disclose Aggregated Data; and (iii) for fraud screening, identity verification, and account information verification. PC Debit Card LLC will also disclose customer data to third parties as outlined in these Terms and Conditions.

User Generated Content

You hereby grant PC Debit Card LLC a non-exclusive, transferable, unlimited, worldwide, irrevocable, sub-licensable and royalty-free license to publish, host, copy, distribute, modify, create derivative works from, reproduce, display, perform, transmit, process or otherwise use in any manner whatsoever and in all formats or distribution methods now known or developed hereafter, all or any portion of your User Content for the purposes of providing, optimizing, improving and promoting our Services. You agree this license includes the right to use your name, persona and likeness included in any User Content in connection with delivering the Services, without any obligation or compensation to you.

  • You agree this license includes the right for PC Debit Card LLC to publish your User Content in a searchable format that may be accessed by other users of the Services.

  • You further agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Services any of the following:

  • User Content that is libelous, defamatory, profane, obscene, pornographic, sexually explicit, indecent, lewd, vulgar, suggestive, violent, harassing, hateful, threatening, offensive, discriminatory, bigoted, abusive, inflammatory, invasive of privacy or publicity rights, fraudulent, deceptive or otherwise objectionable;

  • User Content that is illegal or unlawful, that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, state, national or international law;

  • User Content that may infringe or violate any patent, trademark, trade secret, copyright, or other intellectual or other right of any party;

  • User Content that contains or depicts any statements, remarks or claims that do not reflect your honest views and experiences;

  • Private information of any third-party including, but not limited to, addresses, phone numbers, email addresses, Social Security numbers or credit card numbers;

  • Unsolicited promotions, political campaigning, or commercial messages (SPAM) or any chain messages;

  • User Content designed to deceive or trick the user of the Services;

  • Viruses, corrupted data or other harmful, disruptive or destructive files or code, script or other software designed to automate any functionality on the Services; or

  • User Content that, in the sole judgment of The PC Debit Card LLC, is objectionable.

Collection of Information

As part of PC Debit Card LLC ‘s information collection process, we may detect additional bank accounts under the ownership of the consumer. PC Debit Card LLC may consider these additional accounts to be part of the application process.

Identity Verification

To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. As a result, under our customer identification program, we must ask for your name, street address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents.

Customer Communications

Mobile Phone and Text Communications. You authorize us and our assignees and the affiliates, agents, representatives, assigns and servicers/service providers of ours and our assignees (collectively, the “Messaging Parties”) to contact you using automatic telephone dialing systems, artificial or prerecorded voice message systems, text messaging systems and automated e-mail systems in order to provide you with information about the Services, including information about the Services, including upcoming payment due dates, missed payments and returned payments. You authorize the Messaging Parties to make such contacts using any telephone numbers (including wireless, landline and VOIP numbers) or e-mail addresses you supply to the Messaging Parties in connection with the Services, the Messaging Parties’ servicing and/or collection of amounts you have agreed to pay the Messaging Parties or any other matter. You understand that anyone with access to your telephone or e-mail account may listen to or read the messages the Messaging Parties leave or send you, and you agree that the Messaging Parties will have no liability for anyone accessing such messages. You further understand that, when you receive a telephone call, text message or e-mail, you may incur a charge from the company that provides you with telecommunications, wireless and/or Internet services, and you agree that the Messaging Parties will have no liability for such charges. You expressly authorize the Messaging Parties to monitor and record your calls with the Messaging Parties. You agree that this consent forms part of a bargained-for exchange. If you have the right to revoke text messages and calls to your cell phone or to receive artificial or prerecorded voice message system calls, you may exercise this right only by calling the Messaging Parties at 800-948-5980; or, to stop text messages, by replying “STOP” to any text message the Messaging Parties send you.

Telephone Recording.  You understand and agree that, subject to applicable law, Company Parties may monitor and/or record any of your phone conversations with any of their representatives for training, quality control, evidentiary, and any other purposes.  However, Company Parties are not under any obligation to monitor, record, retain, or reproduce such recordings, unless required by applicable law.

Site Security

As a condition of your use of this Site, you agree that you will not, and you will not take any action intended to: (i) access data that is not intended for you or attempt to reverse engineer the Site; (ii) invade the privacy of, obtain the identity of, or obtain any personal information about any customer or user of this Site; (iii) probe, scan or test the vulnerability of this Site or the MoneyLion network or breach security or authentication measures without proper authorization; (iv) attempt to interfere with service to any user, host or network or otherwise attempt to disrupt our business, including, without limitation, via means of submitting a virus, worm, Trojan Horse, or other destructive feature to this Site, overloading, “flooding,” “spamming,” “mail bombing” or “crashing;” (v) send unsolicited mail, including promotions and/or advertising of products and services; or (vi) attempt to use robots, spiders, intelligent agents, software, tools, engines, or other means to navigate or search the Site other than those generally available through third-party web browsers such as Microsoft Explorer or Google Chrome. Violations of system or network security may result in termination of account and civil or criminal liability.

Limitation of Liability

EXCEPT WHERE PROHIBITED BY LAW, NEITHER MONEYLION, NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUCCESSORS OR ASSIGNS OF EACH, SHALL BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF MONEYLION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.UNLESS OTHERWISE EXPRESSLY SET FORTH IN A WRITTEN AGREEMENT WITH YOU, PC Debit Card LLC MAXIMUM LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS SITE, OR ITS CONTENT, WHETHER IN CONTRACT, TORT OR OTHERWISE SHALL BE LIMITED TO THE AMOUNT YOU PAID TO ACCESS THIS SITE.

Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.

Notice of Agreements Resolving Disputes and Arbitration

By using this site or any of the services provided by PC Debit Card LLC , you agree to be bound by the Agreements Resolving Disputes which includes the Arbitration Agreement (the “Agreement”) the full text of which are provided to you when you apply for or accept a loan or services from the lender or The PC Debit Card LLC and are hereby incorporated into these Terms and Conditions by reference as if fully set forth at this point, and specifically includes the lender making the loan to you. This Agreement provides that all claims arising from or relating to use of the website, product, loan or service provided by the lender or PC Debit Card LLC must be resolved by binding arbitration if the person or entity against whom a claim is made elects to arbitrate the claim. Thus, if the person or entity against whom the claim is made elects to arbitrate the claim, then you will not have the following important rights:

  • You may not file or maintain a lawsuit in any court except a small claims court.

  • You give up your right to have a jury decide your claim.

  • You will not be afforded the procedural, pre-trial discovery, and appellate rights in an arbitration proceeding that you would enjoy in a court or judicial proceeding.

  • You may not join or participate in a class action, act as a class representative or a private attorney general or consolidate your claim with the claims of others.

  • You will have to pay certain fees in order to commence an arbitration proceeding, unless you ask us to pay those fees for you.

If you do not want to arbitrate all claims as provided in the Agreement, then you have the right to reject the Arbitration Provision by delivering a written notice to us at the Notice Address within thirty (30) days following the date of this Agreement.

Indemnity

By using the Site, you agree to indemnify and hold PC Debit Card LLC , its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from and against any and all losses, claims, damages, costs and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with (i) your access to and use of the Service; (ii) your violation of any of the Terms and Conditions referenced herein, or any applicable law or regulation; (iii) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or (iv) any disputes or issues between you and any third-party. The PC Debit Card LLC reserves the right to assume or participate, at your expense, in the investigation, settlement and defense of any such action or claim.

Minors

This Site is not directed at individuals under the age of eighteen (18) or individuals under the age of nineteen (19) in the state of Alabama and The PC Debit Card LLC does not knowingly collect personal information from any individual under the age of eighteen (18) or under the age of nineteen (19) in the state of South Carolina at this Site.

Inactive Applications

Applications are canceled after 7 days of inactivity. Inactivity is defined as any application that is incomplete and cannot be processed and has seen no follow up activity from the customer.

Severability

Any failure by PC Debit Card LLC to exercise any rights or enforce any of these Terms of Use shall not constitute a waiver of such rights or terms If any provision of these Terms of Use or their application in a particular circumstance shall be held by a court of competent jurisdiction to be contrary to law, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law. The remainder of these Terms of Use, or the application of such provision in other circumstances, shall not be affected thereby, and each provision hereof shall be valid and enforced to the fullest extent permitted by law. Assignment

The User or Customer may not assign or delegate this Agreement or any of the terms or conditions hereunder, directly, indirectly, or otherwise without the written consent of the other, and any such purported assignment or delegation shall be void.

Law and Venue

This Site is located in the State of South Carolina. These Terms of Use and the relationship between you and The PC Debit Card LLC shall be governed by the laws of the State of Utah without regard to its conflicts of law provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in South Carolina and agree and consent that such courts are the exclusive forum for litigation of any claim or cause of action arising out of or relating to your use of this Site or the Content. How long does the PC Debit Card keep personal information?

PC Debit Card LLC will maintain the information that is necessary to enable PC Debit Card LLC to provide the requested service and only for as long as it takes PC Debit Card LLC to provide any such requested service. PC Debit Card LLC may still need to keep personal details of customers to ensure that systems reflect your preferences even if a customer has chosen to opt out of allowing PC Debit Card LLC to use that customer’s personal details for marketing purposes.
The Bank Secrecy Act and other federal statutes require PC Debit Card LLC to maintain certain records for a minimum of five years.  PC Debit Card LLC may keep records of any transactions a customer enters into on the PC Debit Card LLC Website for a minimum of six years from the end of The PC Debit Card LLC’s relationship with the customer. I also authorize and consent to The PC Debit Card LLC using such information for other purposes, including obtaining applicable criteria bearing on my creditworthiness, to administer any loan or account I may obtain, for other credit-related purposes connected with any loan or account I may obtain or maintain, to offer other products and services, and for any other uses and purposes permitted by law. The PC Debit Card LLC may make inquiries and requests and receive credit reports, including credit history and standing, from time to time pertaining to me from any consumer credit reporting agency. I understand, acknowledge and agree that The PC Debit Card LLC inquiries concerning my credit history and standing, and requests to receive credit reports, may appear on my credit report and may affect or impact my credit score. I agree that information concerning any loan or extension of credit I receive may be reported to consumer credit reporting agencies. South Carolina Consumer Notice of Rights

If you are a victim of identity theft and provide to a Credit Reporting Agency (CRA) a copy of a valid police report or a valid investigative report made by a Department of Motor Vehicles investigator with peace officer status describing your circumstances, the following shall apply:
